1. About us

These Terms are between you and PGZ AI Solutions, a sole proprietorship of Pugazhenthi N. Our principal place of business is 715-A, 7th Floor, Spencer Plaza, Suite #1544, Mount Road, Anna Salai, Chennai, Tamil Nadu 600002, India.

By using SmokePic, you agree to these Terms.

2. Service description

SmokePic is an AI photo enhancement service. You upload a photo, choose a mode, and we generate a new image using AI models. The service offers 8 modes — Enhance, Passport, Digitals, Professional, Modeling, Lifecycle, Product, and DSLR Transform.

You can also edit any generated photo in TweakRoom, a browser-based editor included with your account at no extra cost.

3. Service availability and generation timing

Photo generations typically complete within 30–60 seconds. The DSLR Transform mode uses a larger model and takes 3–4 minutes per photo.

These are typical times, not guarantees. Generations may take longer during peak load or when an upstream provider is slow. If a generation fails, the coins it would have cost are returned to your account automatically (see §9).

We do not guarantee uninterrupted service. We may pause the service for maintenance with reasonable notice.

4. Eligibility

You must be 18 years or older to use SmokePic. By creating an account, you confirm that you meet this age requirement.

You may not create more than one account. Each person may hold one account.

5. Acceptable use

You may NOT use SmokePic to:

• Generate images of minors as the subject
• Create deepfakes or images that misrepresent another person's identity
• Impersonate any individual or organization
• Generate images of public figures or celebrities without their explicit consent
• Generate content that is illegal under Indian law
• Generate harassment material, sexual content involving real people, or content that incites violence
• Reverse-engineer, scrape, or abuse the service in ways that strain our infrastructure

We use automated safety checks during generation and reserve the right to suspend accounts that repeatedly violate these rules.

6. Your content

You own the photos you upload and the images we generate from them.

By uploading a photo, you grant us a limited license to process it. We use that license to store it, send it to our AI providers for generation, and log it for debugging. This license ends when you delete the content or your account, subject to retention exceptions in our Privacy Policy.

You are responsible for ensuring you have the right to upload the photo — that you took it or have permission from the subject.

7. Provenance and identity-match score

Images you create with SmokePic carry embedded provenance metadata (for example an EXIF/XMP “Software: SmokePic” tag and an AI-content marker) identifying them as AI-generated or AI-enhanced with SmokePic.

We may also compute an identity-match score — an automated estimate of how recognisably the output resembles the person in your source photo. This score is provided for guidance only; it is not a guarantee of likeness and is not any form of identity verification. PGZ AI Solutions accepts no liability for decisions made in reliance on it.

8. Coins and payments

SmokePic uses a coin-based pricing model. Each generation costs 1–3 coins depending on the mode. Current pricing is shown on our pricing page.

• Coins do not expire while your account is active.
• Payments are processed by Razorpay; we do not store your card details.
• GST is collected as required by Indian tax law and shown on your receipt.

9. Refunds

Failed generations: if a generation fails for any reason, the coins it would have cost are returned to your account automatically. No request needed.

Voluntary refunds: unused coins purchased within the last 7 days may be refunded on request. Email support@smokepic.com with your transaction ID. Coins already spent on generations are non-refundable.

10. Account suspension and termination

We may suspend or terminate your account for:

• Violation of the Acceptable Use rules in §5
• Repeated payment fraud or chargebacks
• Abuse that endangers our service or other users

You may delete your account at any time via Settings → Danger Zone. Deletion is permanent. We remove your photos, edits, and remaining coins. Transaction records are retained for 7 years as Indian tax law requires.

11. Disclaimers and liability

SmokePic is provided “as is.” AI-generated images may contain artifacts, distortions, or unexpected elements. We do not guarantee that any output will be suitable for a specific commercial or personal use case.

Our total liability is capped to the maximum extent permitted by law. The cap is the greater of ₹500 or what you paid us in the 6 months before the claim.

We are not liable for indirect, incidental, or consequential damages — including lost profits, lost data, or reputational harm — even if we were advised of the possibility.

12. Indemnity and governing law

You agree to indemnify us against claims arising from your misuse of the service or your violation of these Terms.

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.

13. Grievance redressal (DPDP)

Under the Digital Personal Data Protection Act 2023, you may raise grievances about how we handle your personal data.

We commit to acknowledging your grievance within 7 days and resolving it within 30 days of receipt.

If you are not satisfied with our response, you may escalate to the Data Protection Board of India per the DPDP Act.
